Overview

Yobi Ventures, Inc., and our subsidiaries (“Yobi”, “we”, “our”, “us”) is a pioneer in the field of behavioral artificial intelligence (“AI”), especially in the field of advertising, developing machine learning, media performance optimization, data monetization, and personalization solutions, including our Proprietary Model as described below  (“Solutions”). This privacy notice explains who we are, how we collect, use, and disclose Personal Information through our Solutions (the “Solutions Privacy Notice”), as well as how you can exercise your privacy rights.

 

This Solutions Privacy Notice is intended to inform individuals whose data may be processed through our Solutions (“Individuals” or “you” and “your”) of: (i) the types of information we may gather about you or your device when an advertisement that is optimized by Yobi is delivered to you on a website, connected device, or mobile application you are using, (2) our privacy practices, including how we may collect, use, disclose, and otherwise process Personal Information, and (3) what your rights are with regards to such Personal Information. This Solutions Privacy Notice also explains what non-personal information (“Technical Information”) we collect about the marketing campaigns we service, and how we use that Technical Information to power our Solutions.

 

As used in this Notice, “Personal Information” means information that relates to an identified individual or to an identifiable individual or household. 1. Who is Yobi?

Yobi is a pioneer in the field of behavioral AI, especially in the field of advertising. We are a machine learning and AI company that offers a proprietary model primed (“Proprietary Model”) to predict Individual behavior, not identity. Yobi preserves privacy by transforming raw data, ethically sourced from first party relationships into vector embeddings. Yobi optimizes digital media outcomes and predicts user insights to reach marketing goals for brands, advertisers, agencies, and more (“Customers”).

2. What is our role?

Yobi’s Solutions process Personal Information from various sources to provide our products and services.

 

Generally, when Yobi obtains Personal Information through our technologies, such as the Yobi Pixel, Yobi independently determines the purpose and means of processing this Personal Information and uses such Personal Information as part of the Solutions.

 

Additionally, Yobi’s role related to Personal Information is determined by the specific Solution and the agreement between Yobi and its Customer. For some Solutions and/or Customers, Yobi determines the purpose and means of processing Personal Information, while in other circumstances, the Customer determines the purpose and means of processing Personal Information.

 

When Yobi obtains Personal Information from its Customers, or from third parties on behalf of its Customers, Yobi requires its Customers to maintain any required consents, permissions, and rights to share such Personal Information with Yobi so Yobi can process the Personal Information to develop, operate, and offer its Solutions.

3. What data do we collect?

In order to provide, maintain, and improve our Solutions, Yobi collects and uses Personal and Technical Information through the Yobi Pixel and from our Customers, data brokers, and other third parties subject to appropriate restrictions and safeguards.

 

Yobi obtains the following categories of Personal and Technical Information:

  • Account and interaction information – information contained in an Individual’s account with the Customer or otherwise processed by the Customer.
  • Advertising campaign attributes – the identifier of the advertiser that delivers an ad, its campaign and placement identifiers, the identifiers of the media property selling the inventory to the advertiser, or any intermediary advertising platform.
  • Digital environment attributes – the type of connected device the advertisement is being delivered to (mobile, desktop, connected TV or other device), the browser type and version used to render the page where the ad appears, and the operating system.
  • Electronic presence and identifiers – IP address, email address, user agent string, cookie identifier, advertising identifier, or other identifier shared at the discretion of the Yobi Customer; commercial records such as product and service purchase history; and internet or network activity such as search history or interactions with websites or advertisements.
  • Exposure and engagement attributes – data that shows if the ad was clicked, swiped, tapped or touched, resized, skipped, muted, paused, rotated, hovered, or changed volume.
  • Inferences – drawn from any of the information identified above to create a profile about an Individual, including reflecting that Individual’s preferences, characteristics, behavior, attitudes, abilities, and aptitudes.
  • Viewability attributes – the location of the ad on the page, the size of the ad, the size of the screen, the size of the viewport, the tab focus status, the browser focus status, the time duration the ad was in the viewable part of the webpage and the scroll position of the webpage.
  • Web content attributes – the web address (URL) of the page where the ad is being delivered, and the address of any referring pages.

 

The Solutions collect Personal Information over time and across different online services.

4. How do we process children's data and other sensitive data?

Yobi Solutions and Proprietary Model are not intended to or directed at the processing of Personal Information for children under the age of thirteen (13). We do not knowingly collect Personal Information from such children. If you are a parent or guardian and believe your child’s Personal Information may have been processed through the Solutions, please contact us by using the information in Section 13, “How can you contact Yobi?”.

 

Additionally, Yobi does not use health information, financial creditworthiness, demographic data, or other personal information often described within U.S. privacy laws as “sensitive personal information” to power the Yobi Solutions or Proprietary Model.

5. How do we use the data we collect?

We use Technical Information and Personal Information for the following purposes:

  • Provide reporting, insights, and feedback to our Customers;
  • Identify the Customer we are servicing, apply the correct settings for the Customer, and segment the Customer reports according to these identifiers;
  • Ensure ads are delivered in the correct context;
  • Determine what version of our code will properly run in the environment and properly measure if the advertisement was viewed on the screen;
  • Determine and report to our Customers if the advertisement was viewable;
  • Help our Customers measure the performance of the advertisement, the advertising campaign or the media property;
  • Build, improve, and power the Yobi Solutions;
  • Manage and improve our operations, products, and Solutions;
  • Conduct business operations in support of our core activities, such as security, fraud prevention, analytics, and research and development;
  • Communicate with you and provide you with the information that you have requested from us, and for relationship management, and marketing purposes;
  • Customize content, preferences, and advertising on our Customer’s websites as well as across the Internet and elsewhere;
  • Create aggregated or de-identified information, which we may use and disclose without restriction;
  • Comply with laws, regulations, and other legal process and procedures; including to respond to inquiries from government entities; and
  • Establish, exercise, or defend our legal rights.

6. To whom do we disclose Personal Information?

Yobi may disclose your Personal Information to other parties for our business purposes to operate, support, maintain, and improve our Solutions. The categories of Personal Information can be found in Section 3 “What data do we collect?”. To the extent we voluntarily disclose any Personal Information, we ensure it is protected by the recipients in a manner consistent with our own policies and standards.

 

We may disclose Personal Information as follows:

  • Corporate Transactions: We may disclose Personal Information as part of, or to take steps in anticipation of, a sale of all or a portion of our business, a divestiture, merger, consolidation, asset sale, bankruptcy, or other significant corporate event.
  • Customers and other Business Partners: We may disclose Personal Information to our Customers, suppliers, or other business partners in connection with offering, maintaining, and improving our Solutions and performing our operations.
  • Legal: We may disclose Personal Information when we believe disclosure is appropriate or required to comply with any applicable law, regulation, legal process or government request or to enforce our agreements and policies, including due to a subpoena or similar investigative demand, a court order, or other request by a law enforcement or government agency, or as otherwise required by law. We may disclose Personal Information if we believe, in good faith, that such disclosure is appropriate or necessary to protect or defend our rights or the rights of others, to assist in an investigation or to prevent illegal activity.
  • Parties engaged by our Customers: We may disclose Personal Information to parties engaged by our Customers to support the Solutions or their services. This includes integrating our Solutions with other tools and services directly engaged by our Customer to deliver enhanced services and reporting capabilities. In some circumstances, we may receive data from these integrations that enable Yobi to improve our Proprietary Model.
  • Protection of Yobi and Others: We may disclose Personal Information when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud, or other wrongdoing; to protect and defend the rights, property, or safety of our company, our employees, our partners, or others; and to enforce our contracts and policies.
  • Service Providers and Vendors: We may disclose Personal Information to companies with whom we’ve contracted to provide services to us, such as providers of data storage, engineering services, web hosting, security, analytics, and fraud prevention.   • Subsidiaries: We may disclose Personal Information to our parent company, sister companies, subsidiaries, joint ventures, or other affiliates to operate, maintain and improve our Solutions and our business. You can request a list of our affiliates by contacting us at privacy@yobi.ai.
  • Third Parties involved in a Corporate Transaction: We may disclose Personal Information as part of, or to take steps in anticipation of, a sale of all or a portion of our business, a divestiture, merger, consolidation, asset sale, bankruptcy, or other significant corporate event.
  • Other Lawful Disclosures: We may engage in other disclosures of Personal Information for business purposes that are legally permitted.

 

We may collect information about the Solutions’ performance and may combine this with Personal Information we process about you. We may also process aggregated and deidentified information and share such information with our Customers.

7. How long do we keep Personal Information?

We will retain the Personal Information described in this Solutions Privacy Notice when retention of such Personal Information is reasonably necessary to:

  • Manage our operations, manage your relationship with us, or satisfy another purpose for which we process the Personal Information;
  • Carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was obtained;
  • Protect or defend our rights or property; or
  • Comply with applicable laws or regulations or when we are required or permitted to keep your Personal Information by applicable laws or regulations.

 

If Personal Information is used for more than one purpose, we will retain such Personal Information for the longer of the applicable periods. We may maintain certain Personal Information indefinitely according to legal or regulatory requirements, including applicable legal holds, or for data backup or recovery purposes.

8. How is Personal Information secured?

Yobi has implemented appropriate technical, physical, and organizational measures designed to protect Personal Information against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure or access, as well as other forms of unlawful processing. While we follow generally accepted standards and best practices to protect Personal Information, no method of storage or transmission is completely secure. 9. What are your privacy rights and choices?

Individuals in certain states may have consumer privacy rights enabling them to make requests related to their Personal Information. Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia have several rights under the applicable privacy laws and regulations (“U.S. Privacy Laws”). For persons subject to the applicable U.S. Privacy Laws, these rights are:

  • The right to access any Personal Information we may hold about you, including information about the categories and the specific pieces of Personal Information.
  • The right to correct any inaccurate Personal Information we may hold about you.
  • The right to request that Yobi delete any Personal Information we may hold about you.
  • Under certain circumstances and to the extent technically feasible, the right to request that we provide your Personal Information directly to another (i.e., right to data portability).
  • To the extent your Personal Information is processed based on consent, you have the right to withdraw that consent at any time.
  • To the extent it applies to you and your Personal Data, the right to opt out of sales and sharing for cross-context behavioral advertising or targeted advertising. To opt out visit https://www.yobi.ai/opt-out.

 

To the fullest extent possible, we fulfill any request related to an Individual provided we can match the Individual to the Personal Information we hold in our systems. However, in certain circumstances we may be required to verify your identity to fulfill a request. To verify your identity or understand the scope of your request we may need to request additional information about you. You will need to provide an email address so we can communicate with you and support your request, as well as any information we may need to allow us to verify whether we hold any Personal Information about you. Please be aware that circumstances may exist that will prevent us from being able to fulfill your request, but if we are unable to do so, we will explain why. To the extent we do not hold any Personal Information about you we will let you know. We make best efforts to respond to all inquiries and requests as soon as reasonably possible, but please allow up to thirty (30) days for us to respond.

 

Authorized Agents. Yobi accepts requests from authorized agents on behalf of Individuals who reside in a state that allows requests through an authorized agent. If you are an agent making a request on behalf of an Individual, we reserve the right to take steps to verify that you are authorized to make that request, which may include requiring you to provide us with written proof such as a notarized authentication letter or a power of attorney from the Individual. We also may require the Individual to verify their identity directly with us. If you do not provide the signed designation form or appropriate verification of your authorized status, we cannot honor any requests you submit on behalf of the individual.

 

Appeals. Depending on the state in which you reside, you may be able to appeal a decision made regarding your privacy request by submitting a request to privacy@yobi.ai. In the event we deny your appeal, we will provide a written explanation of the decision, and the instructions on how to contract your local Attorney General, or relevant authority, for further review where permitted under certain U.S. Privacy Law.

10. Additional state-related privacy disclosures

In certain circumstances, Yobi may disclose Personal Information in a way that would constitute “selling” or “sharing” under the California Consumer Privacy Act and similar U.S. Privacy Laws. The categories of Personal Information we may “share” or “sell” can be found in Section 3 “What data do we collect?”. The purpose for which we may “share” or “sell” can be found in Section 5How do we use the data we collect?”. The categories of third parties to whom Yobi may “share” or “sell” Personal Information can be found in Section 6: To whom do we disclose Personal Information?”. The categories of third parties to whom Personal Information may be made available may include marketing partners, data analytics partners, and social media platforms. U.S. Privacy Laws provide residents of these states with the right to opt out of the “sale” or “sharing” of Personal Information. You can opt out as described in Section 9 “What are your privacy rights and choices”.

 

In certain states, we may be considered a data broker. This means we collect and process Personal Information from third-party sources and provide insights, analytics, or services to our Customers based on that information. We do not have a direct relationship with all Individuals whose data we process. We are registered as a data broker, or in the process of registering, in states where required by law, including California, Vermont, Texas, and Oregon. 11. Does Yobi use Artificial Intelligence?

Yobi develops and uses AI in various capacities and ways throughout the organization. While Yobi makes use of these helpful AI technologies, we do not engage in “automated decision-making” or profiling that has a significant legal effect as defined by U.S. Privacy Laws and other applicable regulations.

12. Updates and changes to this Solutions Privacy Notice

Yobi may update this Solutions Privacy Notice from time to time, such as to reflect changes in our practices or to comply with laws and regulations. We will post those changes here or on a similarly accessible page.
